Acceptance
By visiting, browsing or interacting with any site operated by the Ecoflix Foundation â including ecoflix.com and watchecoflix.com â you agree to these Terms of Use. If you don't agree, please don't use the sites.
These terms apply alongside our privacy policy and cookies policy. Together they form the agreement between you and the Foundation.
The Foundation
"Ecoflix Foundation", "we", "us" and "our" refers, jointly and severally, to:
- Ecoflix Foundation Inc., a Delaware not-for-profit corporation, recognised by the IRS as a 501(c)(3) public charity, EIN C2568417, with its principal office at 24730 Long Valley Road, Hidden Hills, Los Angeles, CA 91302, USA.
- Ecoflix Foundation UK, a charity registered with the Charity Commission for England and Wales under number 1200441, with its registered office at Aston House, Redburn Road, Newcastle Upon Tyne, NE5 1NB, United Kingdom.
The two entities work in partnership but are legally separate. Where it matters, this policy says which one applies.
Donations and refunds
Donations to the Foundation are voluntary, irrevocable gifts. We don't sell goods or services in exchange for them.
That said, mistakes happen. If you donate by error â wrong amount, duplicate transaction, intent to give elsewhere â email hello@ecoflix.com within 30 days and we will refund you, no questions asked. After 30 days, refunds are at our discretion.
Recurring donations can be cancelled at any time, either through your Stripe customer portal (a link to which is included with your first receipt) or by emailing us. Cancellation stops future charges; it does not refund previous ones automatically.
If you are a UK taxpayer and you have claimed Gift Aid on a donation we later refund, you are responsible for any tax adjustment with HMRC.
Memberships and the Ecoflix Channel
The Ecoflix Channel (watch.ecoflix.com) is operated by a separate commercial entity, Ecoflix Channel Ltd, under a brand licence from the Foundation. Membership subscriptions are bought from, billed by and refunded by that entity. Their terms â not these ones â govern the relationship.
The Foundation receives no share of channel subscription revenue. The link between the two organisations is the shared mission and brand, nothing more.
If your question is about a paid channel subscription, contact channel support, not the Foundation. We don't have access to subscriber accounts or billing records.
Intellectual property
Everything on ecoflix.com â the writing, the photography, the films, the design, the code, the brand â is owned either by the Foundation, by one of our NGO partners, or by a contributor who has licensed it to us. It is protected by copyright, trademark and other intellectual-property laws.
You may view, share and reasonably quote our public content for non-commercial purposes, provided you credit "Ecoflix Foundation" and link back to the source page. Republishing in full, modifying, or using our material to train a machine-learning model is not permitted without our written consent.
"Ecoflix", the Ecoflix wordmark and the leaf glyph are unregistered trademarks of the Foundation.
User conduct
When you contact us, subscribe to our newsletter, or take part in any programme operated through these sites, you agree:
- To give us accurate information.
- Not to impersonate anyone else.
- Not to use our sites to send unsolicited messages, malware, or anything unlawful.
- Not to attempt to interfere with the security or normal operation of our systems.
- Not to scrape, mirror or systematically extract content for commercial use or to train any AI model.
We may, at our reasonable discretion, refuse service, delete an account or remove content if these rules are broken.
Third-party links and services
Our sites link to NGO partner websites, the payment processor (Stripe), email providers (Buttondown), social platforms and other third parties. Once you leave ecoflix.com, you are subject to their terms and privacy policies, not ours.
We pick our partners carefully but we don't control their content. A link is not an endorsement of everything that organisation does.
Disclaimers
We work hard to keep ecoflix.com accurate and up to date. We can't promise it always will be. The site is provided "as is" and "as available", without warranties of any kind, express or implied, including (without limit) fitness for a particular purpose, merchantability, accuracy and non-infringement.
Project pages describe what our partners are doing on the ground. We do our best to verify their reporting, but the realities of conservation work mean numbers shift. Stats are best estimates at the date shown, not guarantees.
Nothing on this site is financial, legal or tax advice. If you need that, talk to a qualified adviser.
Limitation of liability
To the maximum extent permitted by law, neither the Foundation, its directors, trustees, staff, volunteers, nor any of its partners shall be liable for any indirect, incidental, consequential, special, exemplary or punitive damages arising from your use of the sites.
Where liability cannot lawfully be excluded â for example, for death or personal injury caused by negligence, for fraud, or for breach of statutory rights that cannot be waived â our total cumulative liability to you for any claim is limited to the greater of (a) the amount you donated to the Foundation in the 12 months before the event giving rise to the claim, or (b) US$100.
Indemnity
You agree to indemnify and hold the Foundation, its directors, trustees, staff and volunteers harmless from any claim, loss, liability, expense or cost (including reasonable legal fees) arising out of: (a) your breach of these terms; (b) your misuse of the sites; or (c) any content you submit to us.
Governing law
The applicable law depends on which entity you have engaged with:
- Ecoflix Foundation Inc. â these terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws rules. Any dispute will be brought exclusively in the state or federal courts located in Delaware, except that you may also bring small-claim matters in your local court.
- Ecoflix Foundation UK â these terms are governed by the laws of England and Wales. Any dispute will be brought exclusively in the courts of England and Wales, except that consumers may also rely on the protections of their local courts.
If you donate or interact with the Foundation in a way that does not clearly attach to one entity, the entity in your home jurisdiction (US or UK) applies.
Changes
We may update these terms from time to time. When we make a material change, we will update the "last updated" date at the top of this page. Where it matters â for example, a change to the refund window â we will notify donors and subscribers by email.
If you continue to use the site after a change takes effect, you accept the new version. If you don't, please stop using the sites.
